How do i file to terminate a parents rights

Ok so my question today is, I am raising my husbands adopted sisters son. When he was 3 months old she up and left him in the middle of the night. The lady she was living with woke up when he was crying at about 3am because he was hungry. Needless to say the mother was no where to be found and would not answer her cell phone. In the morning the lady called my mother in law to go get the baby because she was not able to take care of him due to having 5 children of her own. So on December 9th 2006 we took in this beautiful baby boy. Here we are 17 months later and we still have him. He is my son no doubt about it. he calls me mommy and my husband daddy. We love him unconditionally. Our life has been so filled having him in it. His birth mother has been in and out of jail 10 times since we have had him. Either for drug posession or prostitution. We have spoken to a lawyer but he was not very helpful, He said that the longer we have him the better. We just want to make him a permanet fixture of our family so that one day he wont ask why his last name is different. His birth father is a *** offender, on Megans law so he is not allowd contact with him and i really would not think he wanted it either since he has not attempted to find out how he is since his birth. How/what do we do to adopt him and have their parental rights terminated? Any advise would be appreciated.
